Terms of Service | Camp Ope

Welcome to Camp Ope. These Terms of Service ("Terms") govern your use of the campope.com website, platform, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Definitions

"Platform" refers to the Camp Ope website and all associated services.
"Guest" or "Customer" refers to any user who books or intends to book a campsite.
"Campground Operator" refers to campground owners or managers who list properties on the Platform.
"Account" refers to your registered user account on the Platform.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Promptly update your information if it changes
Accept responsibility for all activity under your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Reservations and Bookings

For Guests

Reservations are subject to availability and campground policies.
You agree to provide accurate guest and vehicle information when booking.
Check-in and check-out times are set by the campground operator.
You are responsible for following campground rules during your stay.
Cancellations and refunds are governed by our Refund Policy.

For Campground Operators

You are responsible for the accuracy of your campground listings, including pricing, availability, amenities, and descriptions.
You agree to honor confirmed reservations made through the Platform.
You are responsible for maintaining your property in a safe and habitable condition.
You must comply with all applicable local, state, and federal laws and regulations.

4. Payments

Payments are processed securely through Stripe. By making a payment, you also agree to Stripe's terms of service.
All prices are displayed in US Dollars (USD) unless otherwise specified.
Campground operators set their own pricing. Camp Ope is not responsible for pricing disputes between guests and operators.
Campground operators using Stripe Connect for payouts agree to the Stripe Connected Account Agreement.

5. Subscription Plans (Campground Operators)

Campground operators may subscribe to paid plans (Trailhead, Basecamp) for additional features:

Subscription fees are billed monthly or annually as selected at checkout.
Subscriptions auto-renew unless cancelled before the renewal date.
You may cancel your subscription at any time through the Settings page. Cancellation takes effect at the end of the current billing period.
We do not provide pro-rated refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Submit false, misleading, or fraudulent information
Interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to other accounts or systems
Scrape, harvest, or collect data from the platform without permission
Impersonate another person or entity
Use the Service to send unsolicited communications (spam)

7. Campground Ownership Claims

If you believe you are the legitimate owner/operator of a campground listed on Camp Ope, you may submit a claim through our platform. We review claims in good faith but reserve the right to approve or reject claims at our sole discretion. Submitting a fraudulent claim is a violation of these Terms and may result in account termination.

8. Intellectual Property

The Camp Ope name, logo, and all content, features, and functionality of the Service (including text, graphics, logos, and software) are owned by Camp Ope and are protected by copyright, trademark, and other intellectual property laws.

Campground operators retain ownership of their campground descriptions, images, and listing content, but grant Camp Ope a non-exclusive, worldwide license to display this content on the Platform.

9. Limitation of Liability

Camp Ope is a platform that connects guests with campground operators. We are not the campground operator and do not own, manage, or control any campground listed on the Platform.

To the maximum extent permitted by law, Camp Ope shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid to Camp Ope in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy of campground listings, availability, or pricing.

11. Indemnification

You agree to indemnify and hold harmless Camp Ope, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
